When he became clear that the North Korean pirates used Thorchain to whiten $ 1.4 billion stolen from Crypto Exchange bybit last month, he triggered a confrontation between the operators of the platform.
A group was dismayed and pushed the network to stop until they control the situation.
But others who have devoted themselves to maintaining the decentralization of the network – a current aspiration for blockchain projects – wanted to make it work, no matter who used it, or for what purpose.
The latter group won.
During the following week, the North Korean pirates the Lazare group used Thorchain in the laundering of $ 900 million The value of the crypto, according to an analysis by Taylor Monahan, principal researcher at the Wallet Metamask crypto.
And node operators – volunteers who treat transactions – pocket millions of fees.
Now, the network, specializing in exchanges between incompatible blockchains, faces a barrier of criticism.
The Thorchain dilemma demonstrates the tension between the creation of decentralized financial products and the prevention of the facilitation of criminal activity.
The episode also throws a projector on the question of whether the inaction amounts to knowingly helping in the laundering of stolen funds for a pariah state which displays international law.
Between 2007 and 2023, the Lazarus group hacks cost cryptographic companies and deffi projects on $ 3.4 billionby one DL News calculation.
The pirate group stole 40% of this additional amount in bybit hacking. North Korea uses crypto flight money in advance its nuclear missile program.
Then there is potential legal exposure.
“The decentralized nature of Thorchain does not fully isolates it from the legal ramifications of the facilitation of illicit transactions,” D & A partners of Yuriy Brisov, partner of the Crypto D & A Partners, DL News.
Tornado Cash confidentiality protocol showed what can happen when the authorities are trying to Apply sanctions in crypto.
One of the developers of the protocol, Alexey Pétèsev, was sentenced by a Dutch court in May to a sentence of five years in prison.
Two other developers of the protocol are waiting for a trial in the United States.
There is no indication that Thorchain or his nodes operators are the subject of an investigation in any jurisdiction in his role in the treatment of the piracy product of Bybit.
But if the authorities responsible for the application of sanctions decided to take a step, they could take care of the node operators – many of which are known publicly and reside in the United States.
They knowingly kept the network on the move despite the fact that it manages hundreds of millions of dollars in transactions for North Korea, according to ONCHAIN files.
The robbery of appeal has already become the fabric of the crypto lore given its scale and the brutality of the laundering operation which occurred in its immediate consequences.
On February 21, the North Korean pirates struck the course of the Crypto exchange $ 1.4 billion By compromising the exchange porter of the exchange, Safe Wallet.
As part of Lazarus whitening efforts, he used DEFI exchanges, including Thorchain, to exchange stolen bitcoin and other cryptographic assets.
About 100 volunteer operators manage the Thorchain network and process transactions.
To make changes that would prevent the Lazare group from using Thorchain, the majority of these nodes operators must agree on the action.
On February 26, five days after the hacking of Bybit, some of the Thorchain knot operators stopped by exchanging on its Ethereum version, which Lazarus used mainly, a developer of Thorchain who wanted to remain anonymous, said DL News.
But within 30 minutes, the break was canceled by other node operators who wanted to operate the network.
Conversations in Thorchain discord – a messaging application – Display a divide Between the operators of nodes who wanted to break the network and those who did not do so.
This is not the first time that Thorchain’s node operators have extinguished the network. In January, they temporarily interrupted network loan markets to avoid insolvency.
Thorchain is decentralized and has no central authority – it includes individual operators similar to Bitcoin or Ethereum. Many of its operators and supporters say that the chain has no responsibility to decide who can or cannot use it.
Consequently, no one can comment on behalf of the network.
“The operators of nodes in Thorchain are not different from the operators of nodes on other channels,” said John-Paul Thorbjornsen, an eminent member of the Thorchain community who was part of the network of original developer of the network, said DL News.
“They are not there to forge an opinion on who should use the chain.”
After the break was reversed, Pluto, a pseudonym Thorchain developer who supported the break, go away of the project.
Pluto did not respond to a request for comments.
Thorbjornsen said that node operators are not worried about legal action. They can now run a patch to filter the penalty cryptography addresses, he said.
However, on March 4, Lazarus had used Thorchain in whitening of most crypto stolen by bybit.
Monahan, Metamask researcher, said that she thought Thorchain should have done more to stop Lazarus’s activity.
“Kim Jong a deepest gratitude to Thorchain, Asgardex and Exch”, Monahan said On X, referring to two other exchanges that use Thorchain to facilitate transactions.
The node operators are important to maintain the decentralized model of Thorchain: the costs. Those who have chosen to keep the network on the move have taken $ 5.5 million Combined from Lazarus transactions.
Thorbjornsen said operators should have stopped the entire network and not treat Swaps at all to stop Lazarus.
Anyone who needs Swaps would have gone to the competitors of Thorchain like the Mayan protocol or another centralized service, he said.
The fact that the node operators took advantage of the laundering of the Lazare group raise difficult legal issues.
Riccardo Spagni, former senior manager of Monero, said DL News That he believes that part of the reason why the American authorities came after the developers of Tornado Cash were because they made money from the use by Lazarus of the Tornado cash protocol.
Other anonymizing crypto protocols who did not directly enroll their developers, such as Monero, have not yet attracted the anger of the authorities, despite their Use among criminals.
Thorchain’s whitening debacle arrives at a time when the application of the crypto is in a state of flow.
The United States has sanctioned the Tornado cash protocol because of its use by North Korean silver launders, while two of its developers, Roman Storm and Roman Semenov, are confronted with criminal accusations.
The Storm trial is expected to start on April 14.
And last year, a Dutch court condemned Perseev, another tornado cash promoter, for money laundering because he did not prevent bad players from laundering the illegal product through the protocol.
The court rejected the argument of Pertsev according to which the intelligent protocol contracts are automated so that it is not held responsible.
However, at the same time, the new administration under President Donald Trump adopts a much more indulgent approach to cryptography regulations.
Since Trump took office in January, the Securities and Exchange Commission abandoned several cases against cryptographic companies, in particular Ripple And Jamming.
In November, an American courtyard overturned Sanctions against tornado trees. The sanctions were abolished on March 21.
The opinion of the Court, which was considered an important victory for cryptographic industry, can embrace those who believe that the protocols of decentralized blockchain are exempt from the law.
However, criminal affairs against Storm and Semenov allege The pair knowingly allowed Lazarus to launder the funds by tornado tones and “gave eyes to illicit activity”.
This means that Thorchain operators could, in theory, face a similar action.
Thorchain’s involvement in the exchange of stolen appealing funds raises “parallel concerns” of the use of the Lazarus tornado, said Brisov, the lawyer for the crypto.
The way the violations of sanctions intersect with the DEFI protocols is probably a problem in the foreseeable future.
Lazarus group crypto flights increase in size and frequency, the hacking of $ 1 billion being its biggest robbery to date.
Some DEFI protocols are ready to take a short -term decentralization for fight money laundering.
However, much more side of Thorchain in their conviction that decentralized protocols should not choose who can or cannot use them.
And until the laws and authorities obtain deflected protocols to adopt preventive measures or to face legal consequences, it is sure to say that North Korea will continue to loot the crypto to complete its chests.
